1. Scope
1.1 These General Terms and Conditions (hereinafter "GTC") of Angela Dörler Nutricosmetics (hereinafter "Seller") apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the goods presented in the online shop. The inclusion of the Customer's own terms and conditions is hereby excluded, unless otherwise agreed.
1.2 These Terms and Conditions shall apply accordingly to contracts for the delivery of vouchers, unless otherwise agreed.
1.3 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.
1.4 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.
1.5 Depending on the Seller's product description, the subject matter of the contract may be the purchase of goods either by way of a one-time delivery or by way of a continuous delivery (hereinafter "Subscription Contract"). In the case of a Subscription Contract, the Seller undertakes to deliver the contractually agreed goods to the Customer for the duration of the agreed contract term at the contractually agreed time intervals.
2. Conclusion of contract
2.1 The product descriptions contained in the Seller's online shop do not constitute binding offers, but serve to submit a binding offer by the Customer.
2.2 The customer can submit an offer via the online order form integrated in the online shop. By clicking the final button, the customer submits a legally binding contract offer.
2.3 The Seller may accept the Customer’s offer within five days:

by requesting payment.
If no acceptance is made within this period, the offer shall be deemed rejected.
2.4 If you select a payment method offered by PayPal or Amazon Payments, payment processing will be subject to their terms of use. Details can be found on the respective websites:
2.5 After conclusion of the contract, the contract text will be saved and sent to the customer in text form (e.g., by email). Further information is available in a password-protected customer account, if one has been set up.
2.6 The customer has the opportunity to identify and correct input errors before submitting the order, for example by using the browser's zoom function.
2.7 Only the German language is available for the conclusion of the contract.
2.8 Order processing and contact are generally carried out via email.
3. Right of withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Further information on the right of withdrawal can be found in the seller’s cancellation policy.
4. Prices and payment terms
4.1 The prices quoted are total prices and include statutory VAT. Additional delivery and shipping costs will be quoted separately.
4.2 The available payment options are specified in the Seller’s online shop.
4.3 For payment methods such as PayPal, Klarna, or Shopify Payments, the respective terms and conditions of the payment service providers apply. Details can be found in the linked terms of use:
5. Delivery and shipping conditions
5.1 Delivery shall be made to the address specified by the customer within the specified delivery area.
5.2 If delivery fails for reasons attributable to the customer, the customer shall bear the resulting costs. Exceptions apply when exercising the right of withdrawal.
5.3 For entrepreneurs, the risk of accidental loss or deterioration of the goods shall pass upon handover to the carrier; for consumers, the risk shall pass upon handover to the carrier.
5.4 Self-collection is not possible for logistical reasons.
5.5 Vouchers are provided exclusively by email.
6. Contract duration and termination of subscription contracts
6.1 Subscription contracts are for an indefinite period and can be terminated at any time without notice.
6.2 The right to extraordinary termination remains unaffected.
6.3 Terminations may be made in writing, in text form or via the termination mechanism on the Seller’s website.
7. Retention of title
The seller reserves ownership of the goods until full payment has been made.
8. Liability for defects (warranty)
8.1 Shortened limitation periods and warranty limitations apply to businesses. Consumers are entitled to the statutory warranty rights without restriction.
8.2 Customers are requested to report any transport damage immediately. However, this does not affect their rights.
9. Liability
9.1 The seller shall be liable without limitation in the event of intent, gross negligence and injury to life, body or health.
9.2 In the event of negligent breach of essential contractual obligations, liability is limited to foreseeable, contract-typical damages.
9.3 Otherwise, liability is excluded.
10. Redemption of promotional vouchers
10.1 Vouchers issued free of charge by the Seller as part of promotional campaigns with a specific period of validity and which cannot be purchased by the Customer (hereinafter "promotional vouchers") can only be redeemed in the Seller's online shop and only during the specified period.
10.2 Promotional vouchers can only be redeemed by consumers.
10.3 Individual products may be excluded from the voucher promotion if a corresponding restriction arises from the content of the promotional voucher.
10.4 Promotional vouchers can only be redeemed before the order process is completed. Subsequent crediting is not possible.
10.5 Multiple promotional vouchers can be redeemed in one order.
10.6 The value of the goods must be at least equal to the amount of the promotional voucher. Any remaining balance will not be refunded by the seller.
10.7 If the value of the promotional voucher is not sufficient to cover the order, one of the other payment methods offered by the Seller can be selected to settle the difference.
10.8 The balance of a promotional voucher will not be paid out in cash or bear interest.
10.9 The promotional voucher will not be refunded if the customer returns the goods paid for in whole or in part with the promotional voucher within the scope of his statutory right of withdrawal.
10.10 The promotional voucher is transferable. The seller may discharge the respective holder's liability by making a payment to the respective holder who redeems the promotional voucher in the seller's online shop. This shall not apply if the seller has knowledge or grossly negligent ignorance of the respective holder's ineligibility, legal incapacity, or lack of authority to represent the respective holder.
11. Redemption of gift vouchers
11.1 Vouchers that can be purchased through the Seller's online shop (hereinafter "Gift Vouchers") can only be redeemed in the Seller's online shop, unless otherwise stated in the voucher.
11.2 Gift vouchers and any remaining balance on gift vouchers can be redeemed until the end of the third year following the year of purchase. Any remaining balance will be credited to the customer until the expiration date.
11.3 Gift vouchers can only be redeemed before the order process is completed. Subsequent crediting is not possible.
11.4 Only one gift voucher can be redeemed per order.
11.5 Gift vouchers can only be used to purchase goods and not to purchase additional gift vouchers.
11.6 If the value of the gift voucher is not sufficient to cover the order, one of the other payment methods offered by the Seller can be used to settle the difference.
11.7 The balance of a gift voucher will not be paid out in cash or bear interest.
11.8 The gift voucher is transferable. The seller may discharge the respective holder's liability by making a payment to the respective holder who redeems the gift voucher in the seller's online shop. This shall not apply if the seller has knowledge or grossly negligent ignorance of the respective holder's ineligibility, legal incapacity, or lack of authority to represent the respective holder.
12. Applicable law
All legal relationships between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the laws governing the international sale of movable goods. For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.
13. Place of jurisdiction
If the customer is a merchant, a legal entity under public law, or a special fund under public law with its registered office in the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the seller's place of business. If the customer is based outside the Federal Republic of Germany, the seller's place of business is the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer's professional or commercial activity. In the above cases, however, the seller is entitled in any case to bring proceedings before the court at the customer's place of business.
14. Alternative dispute resolution
14.1 The EU Commission provides a platform for online dispute resolution on the Internet at the following link : https://ec.europa.eu/consumers/odr
This platform serves as a contact point for the out-of-court settlement of disputes arising from online sales or service contracts involving a consumer.
14.2 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
